These Terms of Service (“Terms”) govern your use of the Active 8 mobile application (“App”) operated by Adaptive Solutions LLC (“we,” “us,” or “our”). By creating an account or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
1. Eligibility
You must be at least 13 years old to use Active 8. If you are between 13 and 18 years old, you must have your parent or guardian's consent. By using the App, you represent that you meet these requirements.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of Service
Active 8 is a productivity and scheduling application that provides:
- AI-powered task management and scheduling
- An AI assistant for planning, recommendations, and conversational support
- Daily briefings and schedule optimization
- Calendar integration with third-party services
- Goal tracking and progress monitoring
- Voice input and transcription
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
- Interfere with or disrupt the integrity or performance of the App or its infrastructure.
- Reverse engineer, decompile, or disassemble any part of the App.
- Use the App to transmit harmful, offensive, or illegal content.
- Use automated systems (bots, scrapers) to access the App without our written permission.
- Impersonate another person or misrepresent your affiliation with any entity.
- Use the App to harass, abuse, or harm others.
5. AI-Generated Content
5.1 Nature of AI Content
Active 8 uses third-party artificial intelligence services, including Anthropic and OpenAI, to generate responses, recommendations, schedules, and other content. You acknowledge that:
- AI-generated content is produced by automated systems and may contain errors, inaccuracies, or outdated information.
- AI-generated content does not constitute professional advice of any kind (medical, legal, financial, or otherwise).
- You are solely responsible for any decisions you make based on AI-generated content.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated outputs.
5.2 Your Content
You retain ownership of content you create within the App (tasks, notes, feedback, messages). By using the App, you grant us a limited license to process, store, and transmit your content as necessary to provide the service, including sending relevant content to AI service providers for processing.
6. Health and Wellness Disclaimer
Active 8 is not a medical device and does not provide medical advice, diagnosis, or treatment. Features related to mood tracking, energy levels, wellness suggestions, or schedule optimization based on well-being factors are for informational and organizational purposes only.
- Do not rely on the App for medical decisions.
- Always consult a qualified healthcare professional for health concerns.
- If you are experiencing a medical emergency, contact emergency services immediately.
7. Third-Party Services and Integrations
The App allows you to connect third-party services (Google Calendar, Gmail, Notion, Slack, and others). When you connect these services:
- You authorize us to access and process data from those services as described during the connection process.
- Your use of third-party services is governed by their respective terms and privacy policies.
- We are not responsible for the availability, accuracy, or practices of third-party services.
- You can disconnect integrations at any time from the App's settings.
8. Pricing and Subscriptions
Active 8 is currently available free of charge for waitlist users. We reserve the right to introduce paid subscription tiers or premium features in the future. If we do:
- We will provide advance notice of any pricing changes.
- Existing free-tier functionality available to waitlist users at the time of any pricing change will be honored as communicated.
- Paid subscriptions, if introduced, will be processed through Apple's App Store or Google Play and are subject to their respective billing terms.
9. Account Deletion
You may delete your account at any time through the App's settings or via our web-based deletion form. Upon requesting deletion:
- Your account enters a 30-day grace period during which deletion can be cancelled.
- After 30 days, all personal data is permanently and irreversibly deleted.
- This action cannot be undone after the grace period expires.

10. Intellectual Property
- The App, including its design, code, features, branding, and AI systems, is owned by Adaptive Solutions LLC and protected by intellectual property laws.
- You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
- “Active 8,” “Nora,” and related branding are trademarks of Adaptive Solutions LLC.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.
- We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim (or $100 USD if you have not made any payments).
- We are not liable for any actions you take based on AI-generated content, scheduling suggestions, or wellness recommendations.
12. Indemnification
You agree to indemnify and hold harmless Adaptive Solutions LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.
13. Termination
- You may stop using the App and delete your account at any time.
- We may suspend or terminate your access if you violate these Terms, engage in harmful conduct, or if required by law.
- Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (Limitation of Liability, Indemnification, Governing Law) will continue to apply.
14. Governing Law and Disputes
- These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
- Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
- You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits or class-wide arbitration.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting updated Terms within the App and updating the “Last Updated” date above. Your continued use of the App after changes constitutes your acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the App.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Adaptive Solutions LLC regarding your use of Active 8.
